Ascent Terminal currently operates as an information, market-analysis and paper-trading (simulation) tool only. Live order execution, derivatives / leveraged products, and live automated trading are switched off. Nothing on the Service is, or should be taken as, an offer of trading or investment services. Where this disclaimer refers to trading, execution or automated bots, those describe capabilities that are not currently enabled.
By accessing Ascent Terminal (the “Service”) — the website, web terminal, desktop application, signals, alerts, bot, or any related software — you agree to this disclaimer in full. If you do not agree, do not use the Service.
1. Tools and Information Only — Not Advice
Ascent Terminal provides software tools, market data and analysis for self-directed traders. Nothing provided through the Service is financial, investment, trading, tax or legal advice, and nothing is a recommendation or inducement to buy, sell or hold any asset. You make and are solely responsible for every trading decision; Ascent does not make decisions on your behalf and does not manage funds. We are not a broker, dealer, fund, investment manager or financial adviser. Where the Service executes an order, it does so only on your instruction, using your own connected exchange.
2. No Profit Guarantees; Hypothetical & Backtested Performance
There are no guarantees of profitability, performance, accuracy, or future results. Past performance does not guarantee future results. Backtests, simulations, and historical results are hypothetical and may not reflect actual market performance.
Ascent Terminal is a set of tools and analysis — it is not a turnkey or “plug-and-play” system that produces profits on its own, and it is not a managed trading system. No strategy, bot, signal, indicator, or AI feature can guarantee profitable trading. Any default or out-of-the-box configuration is illustrative only and is not a profitable system. Outcomes depend entirely on your own settings, decisions, market conditions, and risk management.
Any performance figure shown anywhere in the Service — including the Proof view and any CAGR, return, win-rate, or drawdown number — is hypothetical and backtested, was not achieved with real capital, and should be read with the limitations below.
CFTC Rule 4.41 — Hypothetical Performance Disclaimer. Hypothetical or simulated performance results have certain inherent limitations. Unlike an actual performance record, simulated results do not represent actual trading. Also, because the trades have not actually been executed, the results may have under- or over-compensated for the impact, if any, of certain market factors, such as lack of liquidity. Simulated trading programs in general are also subject to the fact that they are designed with the benefit of hindsight. No representation is being made that any account will or is likely to achieve profit or losses similar to those shown.
3. AI-Generated Content
AI commentary in the Service is generated automatically from market data and your own settings. It can be wrong, outdated, or incomplete, is provided for context only, and is never a recommendation to buy, sell, or hold anything. No AI or automated system can predict markets or guarantee profitable trading.
4. Trading Risk
Trading and investing involve substantial risk. You acknowledge that you may lose part or all of your capital. You should never trade with funds you cannot afford to lose.
5. User Responsibility
You are solely responsible for:
- All trading decisions and investments;
- Exchange account and API key management;
- Risk management practices;
- Compliance with the laws and regulations of your jurisdiction.
Ascent Terminal does not make decisions on your behalf. Use only trade-only API keys with withdrawal permissions disabled to minimise risk.
6. Software Limitations
The Service may contain bugs, delays, outages, data inaccuracies, or technical failures. No software can predict markets with certainty. We do not guarantee uninterrupted access, signal accuracy, or error-free operation.
7. Third-Party Risks
Ascent Terminal is not responsible for exchange failures, broker failures, data provider issues, connectivity problems, or API disruptions. Users assume all risks associated with third-party services.
8. Non-Custodial
Non-custodial by design. We never hold your funds or positions, and we never store your exchange API keys at rest. You connect trade-only API keys with withdrawals disabled.
- Manual orders and live bots execute using keys sent from your browser for that session and used only for those actions — we don't retain them. Live bots run only while your terminal tab is open.
- Paper bots, price alerts and server-watched protective exits run on Ascent servers. Paper bots are simulation only (no real funds, no real orders). Alerts and read balances are read-only.
- Optional always-on automation (when and if you enable it) uses an encrypted, withdrawal-disabled key with spend caps and a one-tap kill switch. It is off by default.
You can revoke Ascent's access from your exchange at any time. You are solely responsible for securing your keys and for every resulting trade and outcome.
Automation is not guaranteed to act. Server-watched protective exits and bots are not orders resting on an exchange — they depend on server uptime, data feeds, and exchange availability. If the server is offline, rate-limited, or errors when a level is touched, no order will be placed and a position may remain open. Triggered exits execute as market orders and are subject to slippage, gaps, and illiquidity. Never rely on these features as your only risk control.
9. Jurisdictional Availability
The Service is not directed at any person in a jurisdiction where its use would be contrary to law or regulation, or which would subject Ascent Terminal to any registration requirement there. You are responsible for ensuring your use is lawful where you live.
10. Liability Waiver
To the fullest extent permitted by law, you agree that Ascent Terminal shall not be liable for losses arising from trading activity, market conditions, software errors, signal inaccuracies, or third-party failures. Nothing in this disclaimer excludes liability for death or personal injury caused by negligence, for fraud, or any liability that cannot lawfully be excluded; if you are a consumer, your non-excludable statutory rights are unaffected.
11. Acknowledgement
By using the Service, you acknowledge that:
- Trading involves significant risk;
- You are solely responsible for your decisions;
- You should consider seeking advice from an independent, authorised financial adviser before trading;
- You understand and accept the risks described in this Disclaimer;
- You release Ascent Terminal, its owners, employees, and affiliates from any claims, liability, or losses arising from your use of the Service.
